{"id":4197,"date":"2021-05-24T22:41:40","date_gmt":"2021-05-24T20:41:40","guid":{"rendered":"http:\/\/bozppo-neu.cz\/?page_id=4197"},"modified":"2025-12-29T21:46:20","modified_gmt":"2025-12-29T20:46:20","slug":"ktery-uraz-je-urazem-pracovnim","status":"publish","type":"page","link":"http:\/\/bozppo-neu.cz\/?page_id=4197","title":{"rendered":"Kter\u00fd \u00faraz je \u00farazem pracovn\u00edm?"},"content":{"rendered":"<p><img decoding=\"async\" loading=\"lazy\" class=\"wp-image-1617 alignright\" src=\"http:\/\/bozppo-neu.cz\/wp-content\/uploads\/2017\/02\/po_urazu.gif\" alt=\"po_urazu\" width=\"250\" height=\"234\" \/>Podle ustanoven\u00ed \u00a7 271k z\u00e1kon\u00edku pr\u00e1ce, ve zn\u011bn\u00ed \u010d. 205\/2015 Sb., je pracovn\u00edm \u00farazem po\u0161kozen\u00ed zdrav\u00ed nebo smrt zam\u011bstnance, do\u0161lo-li k\u00a0nim nez\u00e1visle na jeho v\u016fli kr\u00e1tkodob\u00fdm, n\u00e1hl\u00fdm a n\u00e1siln\u00fdm p\u016fsoben\u00edm zevn\u00edch vliv\u016f p\u0159i pln\u011bn\u00ed pracovn\u00edch \u00fakol\u016f nebo v\u00a0p\u0159\u00edm\u00e9 souvislosti s\u00a0n\u00edm.<\/p>\n<p>Jako pracovn\u00ed \u00faraz se t\u00e9\u017e posuzuje \u00faraz, kter\u00fd zam\u011bstnanec utrp\u011bl pro pln\u011bn\u00ed pracovn\u00edch \u00fakol\u016f (nap\u0159. do\u0161lo-li k\u00a0fyzick\u00e9mu napaden\u00ed zam\u011bstnance banky v\u00a0dob\u011b, kdy neprov\u00e1d\u011bl v\u00fdkon pracovn\u00edch \u00fakol\u016f ani \u010dinnost v\u00a0p\u0159\u00edm\u00e9 souvislosti s\u00a0pln\u011bn\u00edm pracovn\u00edch \u00fakol\u016f, z\u00a0d\u016fvodu zam\u00edtnut\u00ed poskytnut\u00ed \u00fav\u011bru s\u00a0n\u00e1sledky, kter\u00e9 lze kvalifikovat jako \u00faraz). Naopak pracovn\u00edm \u00farazem nen\u00ed \u00faraz, kter\u00fd se zam\u011bstnanci p\u0159ihodil p\u0159i cest\u011b do zam\u011bstn\u00e1n\u00ed a zp\u011bt.<\/p>\n<p><strong>Pln\u011bn\u00edm pracovn\u00edch \u00fakol\u016f<\/strong> je v\u00fdkon pracovn\u00edch povinnost\u00ed vypl\u00fdvaj\u00edc\u00edch z\u00a0pracovn\u00edho pom\u011bru a z\u00a0pr\u00e1vn\u00edch vztah\u016f zalo\u017een\u00fdch dohodami o prac\u00edch konan\u00fdch mimo pracovn\u00ed pom\u011br (vypl\u00fdvaj\u00edc\u00ed p\u0159edev\u0161\u00edm ze sjednan\u00e9ho druhu pr\u00e1ce v\u00a0pracovn\u00ed smlouv\u011b), jin\u00e1 \u010dinnost vykon\u00e1van\u00e1 na p\u0159\u00edkaz zam\u011bstnavatele (na p\u0159\u00edkaz nad\u0159\u00edzen\u00e9ho, bez ohledu na to, zda m\u011bl \u010di nem\u011bl opr\u00e1vn\u011bn\u00ed takov\u00fd p\u0159\u00edkaz ud\u011blit) a \u010dinnost, kter\u00e1 je p\u0159edm\u011btem pracovn\u00ed cesty. Tak\u00e9 j\u00edm je \u010dinnost konan\u00e1 pro zam\u011bstnavatele na podn\u011bt odborov\u00e9 organizace, rady zam\u011bstnanc\u016f, pop\u0159\u00edpad\u011b z\u00e1stupce pro oblast bezpe\u010dnosti a ochrany zdrav\u00ed p\u0159i pr\u00e1ci, \u010di \u010dlena Evropsk\u00e9 rady zam\u011bstnanc\u016f, \u010dlena vyjedn\u00e1vac\u00edho v\u00fdboru nebo ostatn\u00edch zam\u011bstnanc\u016f, pop\u0159\u00edpad\u011b \u010dinnost konan\u00e1 pro zam\u011bstnavatele z\u00a0vlastn\u00ed iniciativy, pokud k\u00a0n\u00ed zam\u011bstnanec nepot\u0159ebuje zvl\u00e1\u0161tn\u00ed opr\u00e1vn\u011bn\u00ed nebo ji nevykon\u00e1v\u00e1 proti v\u00fdslovn\u00e9mu z\u00e1kazu zam\u011bstnavatele, jako\u017e i dobrovoln\u00e1 v\u00fdpomoc organizovan\u00e1 zam\u011bstnavatelem (\u00a7 273 z\u00e1kon\u00edku pr\u00e1ce, ve zn\u011bn\u00ed \u010d. 205\/2015 Sb.).<\/p>\n<p><strong>P\u0159\u00edmou souvislost\u00ed s\u00a0pln\u011bn\u00edm pracovn\u00edch \u00fakol\u016f<\/strong> jsou \u00fakony pot\u0159ebn\u00e9 k\u00a0v\u00fdkonu pr\u00e1ce a \u00fakony b\u011bhem pr\u00e1ce obvykl\u00e9 nebo nutn\u00e9 p\u0159ed po\u010d\u00e1tkem pr\u00e1ce nebo po jej\u00edm skon\u010den\u00ed a \u00fakony obvykl\u00e9 v\u00a0dob\u011b p\u0159est\u00e1vky v pr\u00e1ci na j\u00eddlo a oddech konan\u00e9 v\u00a0objektu zam\u011bstnavatele (o jak\u00e9 konkr\u00e9tn\u00ed \u010dinnosti se jedn\u00e1, je t\u0159eba posuzovat p\u0159\u00edpad od p\u0159\u00edpadu, nap\u0159\u00edklad p\u016fjde o p\u0159evl\u00e9k\u00e1n\u00ed se do pracovn\u00edho od\u011bvu v\u00a0\u0161atn\u011b, sprchov\u00e1n\u00ed, tam kde to vy\u017eaduje technologie v\u00fdroby atd.). D\u00e1le jimi jsou vy\u0161et\u0159en\u00ed u poskytovatele zdravotn\u00edch slu\u017eeb prov\u00e1d\u011bn\u00e9 na p\u0159\u00edkaz zam\u011bstnavatele nebo vy\u0161et\u0159en\u00ed v\u00a0souvislosti s\u00a0no\u010dn\u00ed prac\u00ed, o\u0161et\u0159en\u00ed p\u0159i prvn\u00ed pomoci a cesta k\u00a0n\u011bmu a zp\u011bt. Takov\u00fdmi \u00fakony v\u0161ak nejsou cesta do zam\u011bstn\u00e1n\u00ed a zp\u011bt (cesta z\u00a0m\u00edsta zam\u011bstnancova bydli\u0161t\u011b [ubytov\u00e1n\u00ed] do m\u00edsta vstupu do objektu zam\u011bstnavatele nebo na jin\u00e9 m\u00edsto ur\u010den\u00e9 k\u00a0pln\u011bn\u00ed pracovn\u00edch \u00fakol\u016f a zp\u011bt [u zam\u011bstnanc\u016f v\u00a0lesnictv\u00ed, zem\u011bd\u011blstv\u00ed a stavebnictv\u00ed tak\u00e9 cesta na ur\u010den\u00e9 shroma\u017edi\u0161t\u011b a zp\u011bt]; cesta z\u00a0obce bydli\u0161t\u011b zam\u011bstnance na pracovi\u0161t\u011b nebo do m\u00edsta ubytov\u00e1n\u00ed v\u00a0jin\u00e9 obci, kter\u00e1 je c\u00edlem pracovn\u00ed cesty, pokud nen\u00ed sou\u010dasn\u011b obc\u00ed jeho pravideln\u00e9ho pracovi\u0161t\u011b, a zp\u011bt se posuzuje jako nutn\u00fd \u00fakon p\u0159ed po\u010d\u00e1tkem pr\u00e1ce nebo po jej\u00edm skon\u010den\u00ed), stravov\u00e1n\u00ed, vy\u0161et\u0159en\u00ed nebo o\u0161et\u0159en\u00ed u poskytovatele zdravotn\u00edch slu\u017eeb, ani cesta k\u00a0n\u011bmu a zp\u011bt, pokud nen\u00ed kon\u00e1na v\u00a0objektu zam\u011bstnavatele. V p\u0159\u00edm\u00e9 souvislosti s\u00a0pln\u011bn\u00edm pracovn\u00edch \u00fakol\u016f je t\u00e9\u017e \u0161kolen\u00ed zam\u011bstnanc\u016f organizovan\u00e9 zam\u011bstnavatelem nebo odborovou organizac\u00ed, pop\u0159\u00edpad\u011b org\u00e1nem nad\u0159\u00edzen\u00fdm zam\u011bstnavateli, kter\u00fdm se sleduje zvy\u0161ov\u00e1n\u00ed jejich odborn\u00e9 p\u0159ipravenosti (\u00a7 274 z\u00e1kon\u00edku pr\u00e1ce, ve zn\u011bn\u00ed \u010d. 205\/2015 Sb.).<\/p>\n<h4>Druhy pracovn\u00edch \u00faraz\u016f<\/h4>\n<p>Pracovn\u00ed \u00farazy se pro \u00fa\u010dely jejich evidence \u010dlen\u00ed na:<\/p>\n<ul>\n<li>smrteln\u00fd pracovn\u00ed \u00faraz, kter\u00fdm se rozum\u00ed takov\u00e9 po\u0161kozen\u00ed zdrav\u00ed, na jeho\u017e n\u00e1sledky \u00farazem posti\u017een\u00fd zam\u011bstnanec nejpozd\u011bji do jednoho roku ode dne, kdy k pracovn\u00edmu \u00farazu do\u0161lo, zem\u0159el,<\/li>\n<li>z\u00e1va\u017en\u00fd pracovn\u00ed \u00faraz, kter\u00fdm se rozum\u00ed \u00faraz, u kter\u00e9ho trvala hospitalizace v\u00edce ne\u017e p\u011bt po sob\u011b jdouc\u00edch kalend\u00e1\u0159n\u00edch dn\u016f, nebo lze-li vzhledem k povaze zran\u011bn\u00ed takovou dobu hospitalizace p\u0159edpokl\u00e1dat, jako\u017e i \u017eivotu nebezpe\u010dn\u00fd nebo hromadn\u00fd pracovn\u00ed \u00faraz (hornick\u00e1 \u010dinnost a \u010dinnost prov\u00e1d\u011bn\u00e1 hornick\u00fdm zp\u016fsobem),<\/li>\n<li>pracovn\u00ed \u00faraz, u kter\u00e9ho do\u0161lo ke zran\u011bn\u00ed s do\u010dasnou pracovn\u00ed neschopnost\u00ed del\u0161\u00ed ne\u017e t\u0159i kalend\u00e1\u0159n\u00ed dny, p\u0159i\u010dem\u017e se nejedn\u00e1 o z\u00e1va\u017en\u00fd, ani smrteln\u00fd pracovn\u00ed \u00faraz,<\/li>\n<li>pracovn\u00ed \u00faraz, u kter\u00e9ho nebyla zp\u016fsobena do\u010dasn\u00e1 pracovn\u00ed neschopnost nebo byla zp\u016fsobena, av\u0161ak nep\u0159esahuj\u00edc\u00ed t\u0159i kalend\u00e1\u0159n\u00ed dny.<\/li>\n<\/ul>\n<p>K\u00a0jednotliv\u00fdm skupin\u00e1m \u00faraz\u016f se v\u00e1\u017e\u00ed r\u016fzn\u00e9 povinnosti zam\u011bstnavatele &#8211; viz <a href=\"http:\/\/bozppo-neu.cz\/?page_id=73\">zde<\/a>.<\/p>\n<p><a href=\"http:\/\/bozppo-neu.cz\/?page_id=652\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter\" src=\"http:\/\/bozppo-neu.cz\/img\/menubutton.jpg\" alt=\"o uroven vyse\" width=\"50\" height=\"72\" \/><\/a><\/p>\n<p style=\"text-align: right;\">2025-12-29<\/p>\n<p style=\"text-align: right;\">\n","protected":false},"excerpt":{"rendered":"<p>Podle ustanoven\u00ed \u00a7 271k z\u00e1kon\u00edku pr\u00e1ce, ve zn\u011bn\u00ed \u010d. 205\/2015 Sb., je pracovn\u00edm \u00farazem po\u0161kozen\u00ed zdrav\u00ed nebo smrt zam\u011bstnance, do\u0161lo-li k\u00a0nim nez\u00e1visle na jeho v\u016fli kr\u00e1tkodob\u00fdm, n\u00e1hl\u00fdm a n\u00e1siln\u00fdm p\u016fsoben\u00edm zevn\u00edch vliv\u016f p\u0159i pln\u011bn\u00ed pracovn\u00edch \u00fakol\u016f nebo v\u00a0p\u0159\u00edm\u00e9 souvislosti s\u00a0n\u00edm.
